  司法為民的理念強調,司法系統應以民眾福祉為核心,尤其在保護犯罪被害人權益方面更顯重要。為此,建立一個有效的跨機構服務網絡至關重要,該網絡應整合司法機構、社會福利機構、醫療服務、心理諮詢及相關非政府組織,從多個層面提供被害人支持,確保其權益在法律程序和康復過程中獲得充分保障。隨著國際間對犯罪被害人保護與權益的日益重視,我國於2023年7月1日正式施行修訂後的《犯罪被害人權益保障法》,在犯罪被害人權益保障領域相關修法已進一步發展(洪文玲,2023a)。本研究旨在探討修法後,我國犯罪被害人保護機構在服務及跨機關合作網絡方面的現況與成效,採用文獻分析與半結構式深入訪談的研究方法,檢視該法修正條文第5、6、10、15及18條的主要規定,其涵蓋明確跨部會權責、建立服務網絡、調整補償審議時序、增設保護命令以及強化跨部會協作機制等內容。

  本研究發現,儘管修法在加速補償金審議進程及擴大保護範圍方面取得顯著進展,實際在服務被害人及其家屬的過程中仍然面臨許多挑戰。例如,跨部門的協調機制尚未完全順暢,資源整合的難度依然存在。此外,修法後,犯罪被害人保護機構的組織架構亦面臨某些結構性調整問題,則進一步影響服務的連貫性和效率。

  修法在提升被害人權益保障方面邁出重要里程碑,但要實現全面且有效的保護服務,仍須進一步加強部門間的協作與資源整合。本研究建議,政府應建立健全的跨部門合作機制,優化保護機構的資源配置並提升其專業能力,以提高犯罪被害人服務的品質與效率。

  The concept of “judiciary for the people” emphasizes that the judicial system should prioritize the well-being of the public, with particular attention to safeguarding the rights and interests of crime victims. To achieve this, establishing an effective interagency service network is essential. Such a network should integrate judicial institutions, social welfare agencies, healthcare services, psychological counseling, and relevant non-governmental organizations (NGOs) to provide comprehensive support for victims across multiple dimensions. This ensures that their rights are adequately protected throughout legal proceedings and the recovery process. Given the growing international emphasis on crime victim protection, Taiwan implemented the revised Crime Victim Protection Act on July 1, 2023, marking a significant development in the legislative framework for victim rights. This study aims to examine the current state and effectiveness of victim protection agencies in Taiwan following the legal amendments, particularly in terms of service provision and interagency collaboration. Using a qualitative research approach that combines literature review and in-depth interviews, this study analyzes key provisions of the revised law, specifically Articles 5, 6, 10, 15, and 18. These amendments include the clarification of inter- ministerial responsibilities, the establishment of service networks, adjustments to the sequence of compensation reviews, the introduction of protection orders, and the enhancement of interagency coordination mechanisms.
  The study finds that although the legal amendments have made significant progress in expediting the compensation review process and expanding the scope of protection, there are still many challenges in the practical service delivery to victims and their families. For instance, the interdepartmental coordination mechanism is not yet fully streamlined, and difficulties in resource integration persist. Additionally, after the amendment, crime victim protection agencies face certain structural adjustments, which further affect the consistency and efficiency of their services.
  The legal amendments represent a significant milestone in enhancing the protection of crime victims’ rights. However, achieving a comprehensive and effective victim protection service still requires further strengthening of interdepartmental collaboration and resource integration. This study suggests that the government should establish a well-structured interagency cooperation mechanism, optimize the allocation of resources for victim protection agencies, and enhance their professional capabilities. These measures would improve both the quality and efficiency of services for crime victims.
